A collaborative dialogue discusses the status of cooperatives in the draft Palestinian interim constitution with national, regional, and international participation

Mujawarah for Life and Development – United Kingdom, in partnership with the General Cooperative Union – Palestine and in cooperation with the Cooperative Work Sector at the Palestinian Ministry of Labour, organised a panel discussion as part of the “Cooperatives in Palestine” Forum. The session, titled “The Status of Cooperatives in the Palestinian Interim Constitution”, was held on Saturday, 11 April 2026, via the Zoom platform, with the participation of a distinguished group of Arab and international legal, economic, and cooperative experts.

The discussion addressed two main themes. The first focused on the absence of cooperatives in the draft Palestinian interim constitution and the implications of this omission for the conceptualisation of the economic system, as well as the possible options to address it. This theme featured national contributions, including an opening intervention reflecting the perspective of the cooperative movement in Palestine, delivered by Ezzeddin Abu Taha, alongside a contribution from Shawkat Sarsour. The speakers discussed the position of the cooperative sector within the economic structure and presented constitutional and legal proposals to strengthen its recognition.

The second theme explored Arab and international approaches to the constitutionalisation of cooperatives through comparative experiences and an analysis of the impact of recognising cooperatives within economic and development policies. This segment included an international contribution by Dr. Hogan Henry, as well as regional contributions from Dr. Ahmed Abdel-Zaher and Abdelfattah Al-Shalabi. They examined various constitutional and legislative frameworks and the role of the cooperative movement in advancing its presence within public policy.

The discussion was moderated by Nour Hoteit, and also featured interventions from participants, including representatives of the Cooperative Work Sector at the Palestinian Ministry of Labour, members of the Palestinian cooperative movement, and representatives of civil society organisations. These contributions enriched the discussion with practical insights and recommendations reflecting the needs and challenges of the cooperative sector.

This dialogue took place amid ongoing discussions surrounding the draft Palestinian interim constitution, which notably lacks any explicit reference to cooperatives as a component of the economic system. This is despite the draft’s adoption of a mixed economy model based on market mechanisms and competition, raising fundamental questions about the place of the cooperative sector within the constitutional vision of the Palestinian economy.

The discussion concluded with a set of legal and cooperative recommendations, to be submitted to the constitutional drafting committee within the designated period for public feedback on the draft. These recommendations aim to strengthen the status of cooperatives within the constitutional framework of the Palestinian economic system, in alignment with the national context and the requirements of economic and social development.

The organisation of this discussion forms part of the “Cooperatives in Palestine” Forum, which serves as a platform for dialogue and knowledge exchange aimed at strengthening institutional discussion on the current state and future of Palestinian cooperative work, and promoting experience-based knowledge and policy analysis to support the development of the cooperative sector and enhance its role in strengthening the resilience of local communities.

حوارية تعاونية تناقش مكانة التعاونيات في مسودة الدستور الفلسطيني المؤقت بمشاركة وطنية وإقليمية ودولية

نظمت مؤسسة مجاورة للحياة والتنمية- بريطانيا بالشراكة مع الاتحاد التعاوني العام وبالتعاون مع قطاع العمل التعاوني في وزارة العمل ضمن فعاليات منتدى “تعاونيات من فلسطين” حوارية حول “مكانة التعاونيات في مسودة الدستور الفلسطيني المؤقت”، وذلك اليوم السبت الموافق 11 نيسان/أبريل 2026، عبر منصة “زووم”، بمشاركة نخبة من الخبراء القانونيين، والاقتصاديين، والتعاونيين العرب ،والدوليين

وتناولت الحوارية محورين رئيسيين، حيث ركز المحور الأول على غياب التعاونيات في مسودة الدستور الفلسطيني المؤقت، وما يحمله هذا الغياب من دلالات على مستوى تصور النظام الاقتصادي، والخيارات الممكنة لمعالجته. وشهد هذا المحور مداخلات وطنية ومداخلة افتتاحية عبرت عن وجهة نظر الحركة التعاونية في فلسطين قدمها الأمين العام للاتحاد التعاوني العام عز الدين أبو طه، إلى جانب مداخلة للخبير التعاوني شوكت صرصور، حيث تناولت المداخلات موقع القطاع التعاوني في البنية الاقتصادية، إضافة إلى طرح مقترحات دستورية وقانونية لتعزيز الاعتراف به

أما المحور الثاني، فقد تناول المقاربات العربية والدولية في دسترة التعاونيات، من خلال استعراض تجارب مقارنة وتحليل أثر الاعتراف بالتعاونيات في السياسات الاقتصادية والتنموية. وتضمن هذا المحور مداخلة دولية قدمها الخبير القانوني في الاتحاد التعاوني الدولي د. هاغن هنري، إلى جانب مداخلات إقليمية لكل من رئيس الاتحاد التعاوني العربي والإفريقي د. أحمد عبد الظاهر، ورئيس المؤسسة التعاونية الأردنية عبد الفتاح الشلبي، حيث ناقشوا الأطر الدستورية والتشريعية المختلفة، ودور الحركة التعاونية في الدفع نحو تعزيز حضورها في السياسات العامة

كما شهدت الحوارية مداخلات من المشاركين، بدأت بمداخلة للدكتورة بنان الطوري عن قطاع العمل التعاوني في وزارة العمل في فلسطين، وشارك في النقاش أعضاء من الحركة التعاونية في فلسطين، وممثلين عن مؤسسات المجتمع المدني، حيث ساهمت هذه المداخلات في إثراء النقاش وطرح رؤى عملية وتوصيات تعكس احتياجات القطاع التعاوني وتحدياته

وجاءت هذه الحوارية في ظل النقاشات الجارية حول مسودة الدستور الفلسطيني المؤقت، والتي أظهرت غياباً لأي نص صريح يتناول التعاونيات ضمن مكونات النظام الاقتصادي، رغم تبني المسودة نموذج الاقتصاد المختلط القائم على آليات السوق والمنافسة، الأمر الذي أثار تساؤلات جوهرية حول مكانة القطاع التعاوني في الرؤية الدستورية للاقتصاد الفلسطيني

خرجت الحوارية بمجموعة من التوصيات القانونية والتعاونية، تمهيداً لرفعها إلى لجنة صياغة الدستور ضمن الفترة المحددة لإبداء الملاحظات على المسودة، بما يسهم في تعزيز مكانة التعاونيات ضمن الإطار الدستوري للنظام الاقتصادي الفلسطيني، وبما ينسجم مع خصوصية السياق الوطني ومتطلبات التنمية الاقتصادية والاجتماعية

وجاء تنظيم هذه الحوارية ضمن إطار منتدى “تعاونيات من فلسطين”، بوصفه منصة حوارية ومعرفية تهدف إلى تعزيز النقاش المؤسسي حول واقع ومستقبل العمل التعاوني الفلسطيني، وتبادل المعرفة المبنية على التجربة العملية والتحليل السياساتي، بما يسهم في تطوير القطاع التعاوني وتعزيز دوره في دعم صمود المجتمعات المحلية
